Selling a Loxahatchee River Home in Jupiter: Dock Rules and Buyer Questions

Short answer: much of the Loxahatchee River and Lake Worth Creek in Jupiter and Tequesta sits in a state aquatic preserve, where single-family docks face strict size and depth limits. For a riverfront seller, that makes your existing dock, its permits and its condition a core part of value. Buyers cannot assume they can build a larger one.

I am Kyle Camerlinck, broker and owner of Taiter Realty in Jupiter. I have been a licensed Florida real estate professional since December 15, 2020, and I hold Florida broker license BK3487029. River homes trade on a different checklist than Intracoastal or oceanfront homes. Buyers here are paying for water, privacy and a natural shoreline, and they want to know exactly what the dock can and cannot become.

What protections apply to the Loxahatchee River?

Wild and Scenic River. The National Wild and Scenic Rivers System lists the Loxahatchee River as designated May 17, 1985, from Riverbend Park downstream to Jonathan Dickinson State Park, 7.6 miles in total.

Aquatic preserve. The Florida Department of Environmental Protection's Loxahatchee River-Lake Worth Creek Aquatic Preserve Management Plan, approved December 4, 2018, describes a preserve of about 1,739 acres in Palm Beach and Martin counties that lies within Jupiter and Tequesta. It covers the North Fork, the Southwest Fork to I-95 and the C-18 canal, and Lake Worth Creek to the Florida Inland Navigation District office at Marcinski Road, ending east at the Jupiter Inlet.

Whether your specific shoreline is within the preserve boundary: TBD, confirmed with DEP for your parcel.

What do aquatic preserve rules mean for a dock?

Docks in Florida aquatic preserves are governed by rule 18-20.004, Florida Administrative Code. For private single-family docks, the rule sets these standards, among others:

  • No dock may extend more than 500 feet or 20% of the waterbody's width, whichever is less.
  • The main access dock is limited to four feet wide.
  • The dock may extend no farther than the minus four foot mean low water depth, and where that depth is reached at an existing bulkhead, the dock may extend at most 25 feet from it.
  • The terminal platform may be no larger than 160 square feet.
  • Dredging for navigable depth with a single-family dock is strongly discouraged.

The rule also lets existing docks built under prior rules be maintained. If more than 50% of a nonconforming structure falls into disrepair or is destroyed, the whole structure must be brought into full compliance. For a seller, that line matters. A well-maintained grandfathered dock can be worth more than anything a buyer could permit today, and a neglected one can lose that status.

How I prepare a Loxahatchee River listing

  • Dock file. Permits for the dock and lift, a marine contractor's condition report, and measured water depth at the dock at low tide.
  • Route to the inlet. Bridge clearances between your dock and the Jupiter Inlet. I cover them in my Jupiter bridge clearance and air draft guide.
  • Shoreline. Seawall or natural shoreline condition and any related permits.
  • Flood and insurance. Elevation certificate, wind mitigation report and current premiums. Florida law (section 689.302, Florida Statutes, as amended) requires every residential seller to give the buyer a written flood disclosure at or before contract. It asks whether you know of any flooding that damaged the property during your ownership, whether you filed a flood claim, and whether you received assistance from any source, including FEMA.
  • Pricing. Comparable closed sales on the river with similar dock capability, not Intracoastal sales. Recent river closings for your home: TBD, pulled from the MLS and the Palm Beach County Property Appraiser.

Dock and lift approvals often involve more than one agency. My Jupiter dock and boatlift permits guide lays out who regulates what.

Frequently asked questions

Is the Loxahatchee River protected?

Yes. The Northwest Fork from Riverbend Park downstream to Jonathan Dickinson State Park was federally designated a National Wild and Scenic River on May 17, 1985, totaling 7.6 miles. Separately, the Loxahatchee River-Lake Worth Creek Aquatic Preserve covers waters in Jupiter and Tequesta.

Can a buyer build a bigger dock on the Loxahatchee?

It depends on location and permits. In Florida aquatic preserves, rule 18-20.004, F.A.C., limits a single-family dock's main access walkway to four feet wide, its terminal platform to 160 square feet, and its reach to the minus four foot mean low water depth, along with the 500 foot or 20% of waterbody width cap. A buyer planning an expansion should confirm what is allowed at your address.

What happens to an existing dock that does not meet current aquatic preserve rules?

Rule 18-20.004 authorizes existing docks built under prior rules to be maintained. If more than 50% of a nonconforming structure falls into disrepair or is destroyed, the entire structure must be brought into full compliance with current rules.

Which waters are in the aquatic preserve?

DEP's management plan describes the preserve as covering about 1,739 acres in Palm Beach and Martin counties, within Jupiter and Tequesta, including the North Fork, the Southwest Fork to I-95 and the C-18 canal, and Lake Worth Creek to the Florida Inland Navigation District office at Marcinski Road.

What do river buyers ask first?

Water depth at the dock, bridge clearances to the Jupiter Inlet, dock and lift permits and condition, seawall or shoreline condition, and flood zone and insurance. Have those answers ready before the listing goes live.

My recommendation

Treat your dock as a regulated asset, not an accessory. Document it, maintain it, and market what it can do today. On the Loxahatchee, the dock you already have may be one a buyer could not build.

If you are thinking about selling in the next 6 to 24 months, send me your address and I will put together a private value range built on recent closed sales, not list prices. No obligation, and nothing goes on the market until you decide.

This article is general information, not legal, tax, insurance, or financial advice, and it is not an appraisal. Rules and agency interpretations change; confirm dock and preserve requirements for your parcel with DEP and your permitting professional. Items marked TBD are figures I have not verified.
